These Terms of Service ("Terms") govern your access to and use of naperest.com (the "Site") and any purchase made through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are

2. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to purchase from the Site.

3. Products and honest description

We describe our products as accurately as we can, including what they do and what they do not do. NapeRest products are general wellness devices intended for relaxation and temporary relief of the sensation of muscle tension. They are not medical devices and are not intended to diagnose, treat, cure, correct, or prevent any disease or condition. Please read our Medical Disclaimer, which forms part of these Terms.

Product images are for illustration; minor variations in color and finish can occur. We reserve the right to correct errors in descriptions, pricing, and availability, including after an order is placed; if a material error affects your order, we will contact you with the option of confirming at the correct terms or receiving a full refund.

4. Orders and payment

Your order is an offer to purchase; it is accepted when we send a shipping confirmation. We may refuse or cancel any order for reasons including suspected fraud, pricing errors, or stock unavailability, in which case any amount paid is refunded in full. Prices are displayed in the currency shown at checkout and include or exclude taxes as indicated there.

5. Shipping, returns, and warranty

Shipping timelines are described in our Shipping Policy. Returns and refunds are governed by our Refund Policy, including the 100-Night Rest Guarantee, the included standard warranty, and the optional 2-Year Extended Protection Plan. Both policies form part of these Terms.

6. Proper use

Products must be used in accordance with the included instructions. We are not responsible for issues arising from use contrary to the instructions, disassembly, or modification of the product.

7. Intellectual property

All content on the Site, including text, images, logos, product design, and layout, is owned by or licensed to us and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

8. Reviews and submissions

By submitting a review, photo, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and adapt it in connection with our products and marketing. You confirm your submission is your own honest experience and does not infringe any third-party rights. We display genuine customer feedback and reserve the right not to publish content that is unlawful, offensive, or unrelated to the product.

9. Disclaimer of warranties

Except as expressly stated in our Refund Policy and warranty terms, the Site and products are provided "as is" and "as available", and we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or relating to these Terms or any purchase is limited to the amount you paid for the product giving rise to the claim, and we are not liable for indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence or for fraud.

11. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any dispute that cannot be resolved amicably through contact@naperest.com shall be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the seat of arbitration in Cheyenne, Wyoming. You and NapeRest each waive the right to a jury trial and to participate in a class action, to the extent permitted by law.

Consumers in the United Kingdom: nothing in this section deprives you of the protection of mandatory provisions of the law of your country of residence, and you retain the right to bring proceedings in your local courts where that right cannot be waived. Your statutory rights remain unaffected.

12. Changes to these Terms

We may update these Terms from time to time. The version in force at the time of your order applies to that order. Continued use of the Site after changes constitutes acceptance of the updated Terms.

13. Severability and entire agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the Refund Policy, Shipping Policy, Privacy Policy, and Medical Disclaimer, constitute the entire agreement between you and NapeRest regarding the Site and your purchases.
